For 2025, the Federal Employees Health Benefits (FEHB) Program will offer expanded fertility benefits to the federal workforce and their families. Every FEHB enrollee, regardless of where they live, will now have more than one plan to choose from that includes IVF coverage.

The 2025 fertility benefits include:

  • Coverage for artificial insemination or IUI, including medications used in an IUI cycle.
  • Medications needed for up to three cycles of IVF.
  • Every state will offer at least two plan options for IVF coverage.
  • 13 states, sub-states and 3 territories will offer additional plans that include benefits above the minimum requirements listed above:
    • The states, regions, and territories include California, Colorado, Hawaii, Illinois, Maryland, Michigan, New Mexico, New York, Pennsylvania, Texas, Utah, Virginia, District of Columbia, Guam, Puerto Rico, and U.S. Virgin Islands.
    • Several local/regional plans offer IVF with no cycle or dollar limits.

During Open Season, FEHB enrollees can choose a plan with the fertility benefits if they are not already enrolled in one.

RESOLVE applauds the federal government — the largest employer in the United States — for expanding fertility benefits for its over 2 million employees. For decades, federal employees had to scrimp and save to access needed fertility treatments, most of which were not covered through their health insurance provided through FEHBP.

This expansion of access is certainly significant to the 2 million employees and their families – totaling 8 million people – but importantly it sends a message to private and other public providers that adding and expanding fertility benefits is the right thing to do. While Plan Year 2025 will see the most coverage options ever for fertility treatments for federal employees, there is still work to be done. RESOLVE wants to see IVF medical treatment as a required benefit in every plan offered by FEHBP, ensuring continuity in coverage from year to year.

The proposed legislation would both establish a nationwide right to in-vitro fertilization (IVF) and other assisted reproductive technology and open access to IVF medical treatments for the millions of people who need it to have a child.

A chance to make real change for American families was squandered and IVF remains at risk across the country. We are disappointed — but not surprised — that the Senate once again failed to pass comprehensive family building legislation to ensure IVF remains available and accessible and that patients and providers are protected.

Since the Alabama ruling, we have heard countless claims from Congressional lawmakers that they support access to this life-changing healthcare. Today, we are reminded that promises without action are empty.

With more than 50 years of advocacy on behalf of the family building community, RESOLVE knows that families across the country need the Right to IVF Act to reduce barriers to IVF treatment and ensure this healthcare remains available nationwide–it is a real problem that needs a solution. We will not stop fighting until there are federal protections for IVF and will continue to urge all legislators to join our efforts to make it easier – not harder – for people to grow their families.

Since becoming the Democratic party’s nominee for Vice President in the 2024 race, significant attention has been paid to the family building journey of Gov. Tim Walz (MN) and his wife, Gwen. The campaign recently verified that, while a supporter of IVF, the Walzes were able to build their family through intrauterine insemination or IUI. This deeply personal information was only recently clarified. RESOLVE regrets if our organization contributed to any confusion about how he became a parent. We support all paths to parenthood and have welcomed Gov. Walz’s support of our community and our advocacy issues, since our federal Advocacy Day in 2017 during his tenure in Congress.

Right now, we are focused on the serious obstacles facing our community. This year has seen an increase in the number of bills and court rulings that threaten to restrict access to medically necessary care for people who struggle to build a family. Health insurance coverage to support infertility treatment is piecemeal and inadequate. Our active duty military and veterans lack the full access and coverage they deserve.

The ongoing conversation around the importance of IVF access and other fertility treatments has made millions of would-be parents across the country feel seen. We need our elected representatives at the state and federal level, and government officials to do everything in their power to make it easier, not harder, for people to build their families.

The ‘childless cat lady’ rhetoric being used to degrade people without children is painful and tone-deaf. People are childfree for many reasons — from grieving the pain of miscarriage to experiencing failed adoptions or rounds of fertility treatments to making their own choice not to have children. For some, living without children doesn’t feel like a choice that they made, but a choice that they live with, despite trying to grow their families. Under no circumstances, should living childfree be weaponized in a way that degrades people or their value to society.

WASHINGTON — Barbara Collura, President and CEO of RESOLVE: The National Infertility Association and leader of the organization’s Fight For Families Campaign, issued the following statement after the U.S. Senate failed to vote to advance the Right to IVF Act:

This is not the end of our fight for family building for all. We will continue until everyone in this country has access to the family building options they need and the availability of IVF is guaranteed in all 50 states. Introducing this bill was already a big win for advocates of increasing access to fertility treatments. Our work led to this comprehensive legislation, and we are not giving up.

“This vote showed us where we need to do more work. We see who needs to learn more about IVF and hear from patients about their struggles to create a family. With more than 50 years of advocacy on behalf of family building, we know what is needed to guarantee people’s rights to all family building options. Just since Roe was dismantled, we’ve faced 40 state bills that have threatened the availability of IVF and ultimately delivered nothing to millions of Americans.

“Statements showing support for IVF don’t do anything to change policy, and they don’t protect people from losing their right to access the care they need. Elected officials across the political spectrum should listen to their constituents: Family building through IVF is more popular than virtually any other issue with 85% of Americans supporting its access. Even with this reality, yesterday’s resolution from the Southern Baptist Convention was another painful reminder that access to IVF is under attack across the country.

“We are committed to continued education and advocacy on behalf of the one in six in our country who face infertility. The Right to IVF Act is the only legislation available to establish a nationwide right to in-vitro fertilization (IVF) and other assisted reproductive technology and provides access to insurance coverage for the millions of families who need IVF to have their children, including our military families.

“The sweeping legislation was sponsored by Senators Tammy Duckworth (D-IL), Patty Murray (D-WA) and Cory Booker (D-NJ) to both establish a nationwide right to in-vitro fertilization (IVF) and reduce the barriers to access IVF treatment for the millions of families who need it to build or grow their family. 48 Senators voted to advance the bill to a full Senate vote, short of the 60 needed.”

Barbara Collura, President and CEO of RESOLVE: The National Infertility Association and leader of the organization’s Fight For Families Campaign, issued the following statement in response to legislation introduced by Senator Ted Cruz (R-TX) and Senator Katie Britt (R-AL) to protect IVF:

We appreciate that Senators Ted Cruz (R-TX) and Katie Britt (R-AL) have expressed a commitment to support IVF, a stance that 85 percent of Americans share. We have concerns, however, with how the bill is drafted. The bill allows for states to push for regulations that could severely reduce the standard of care for IVF treatment, such as restrictions on how many embryos are created and what individuals can do with these embryos — decisions that should only be made between patients and their doctors, based on science and clinical guidelines.

The solution is federal legislation that enshrines access to IVF for all. Fortunately, the Access to Family Building Act introduced by Senator Duckworth is currently being considered and would prevent any restrictions on this life-changing care. We call on members of Congress on both sides of the aisle to come together and pass this legislation immediately.

Barbara Collura, President and CEO of RESOLVE: The National Infertility Association and leader of the organization’s Fight For Families Campaign, issued the following statement in response to the Senate Judiciary Committee’s Hearing on The Continued Assault on Reproductive Freedoms in a Post-Dobbs America:

Today’s hearing affirmed what we know to be true – many of our nation’s leaders do not have the medical expertise necessary to push forward legislation that would stand between a patient and their doctor. Moreover, some legislators don’t even understand the urgency of this moment for those living with infertility. Senator Ted Cruz (R-TX) went as far as to claim that ‘IVF is fully protected in law’, which is categorically false. There are no existing legal protections for IVF.

“Despite what we heard today, it is impossible to claim to support IVF while simultaneously pushing for regulations that would significantly reduce the standard of care patients need to build families through this life-changing healthcare. The Life at Conception Act – which would establish human life as beginning at the moment of fertilization and replicate the devastating outcomes we saw in Alabama – currently has 125 Republican sponsors. Make no mistake: there is nothing pro-family about this bill or actions to curtail reproductive healthcare.

Most Americans – 85 percent of adults – are in support of increasing access to fertility treatments. But access to IVF will only decrease if misguided regulations supersede medical best practices – this safe and essential care will become more expensive and more dangerous for those already carrying the financial, physical and emotional weight of infertility.

Unfortunately, what happened in Alabama was not a fluke. Since the Dobbs decision, we have tracked and fought against state bills that try to define when life begins, and in the process create definitions that would undercut access to the medical interventions hopeful parents need to build their families.

We will remain gravely concerned about the future of IVF throughout the country until federal protections are in place. We must call on our congressional leaders to pass the Access to Family Building Act as soon as possible. But until this bill becomes law, it is incumbent on state leaders to make choices for their constituents that make it easier — not harder — for them to build their families.
