About the Adoption Tax Credit

RESOLVE believes adoption should be accessible to all families, regardless of income. That’s why we are part of the Adoption Tax Credit Working Group, a coalition of more than 150 organizations advocating to make the Adoption Tax Credit (ATC) refundable.

Currently, many lower- and middle-income families can’t benefit from the credit because it only offsets taxes owed. By restoring refundability, families would receive the full credit, helping to ease the financial cost of adoption and making it possible for more children to find loving homes.

The Adoption Tax Credit Refundability Act (S. 1458/H.R. 2833) has been introduced in Congress to make this change. RESOLVE strongly supports this bill and continues to work with our partners to advocate for its passage.

The 2025 major spending package was signed into law on July 4th. It included a major enhancement to the Adoption Tax Credit, making up to $5,000 of the credit refundable, even for families who owe no federal taxes. The maximum credit has also been increased and adjusted for inflation, making it more meaningful for families pursuing adoption through foster care, private domestic, or international routes.
